Acceptance of Terms

By accessing and using the Techoras website (techoras.pro) or engaging our property management services, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our website or services. These terms constitute a legally binding agreement between you and Techoras B.V.

Techoras B.V. is a Dutch limited liability company registered with the Chamber of Commerce (KvK) under number 68139527, with VAT number NL859402173B01. Our registered office is located at Berkenlaan 17, 4838 CD Breda, Netherlands.

Services Description

Techoras provides comprehensive property management services including but not limited to tenant management, property maintenance coordination, financial reporting, legal compliance assistance, and related real estate management services. Specific services will be detailed in individual service agreements with clients.

Website Use

You may use our website for lawful purposes only. You agree not to use the website in any way that violates applicable laws or regulations, infringes on the rights of others, transmits harmful or malicious content, attempts to gain unauthorised access to our systems, or interferes with the proper functioning of the website. We reserve the right to terminate or restrict your access to the website at our discretion.

Service Agreements

Property management services are provided under separate written agreements that specify the scope of services, fees, responsibilities, and terms specific to your property. These Terms of Service supplement but do not replace individual service agreements. In case of conflict between these general terms and a specific service agreement, the service agreement shall prevail.

Fees and Payment

Fees for property management services will be specified in your individual service agreement. Payment terms, methods, and schedules will be outlined in the service agreement. Late payment charges may apply as specified in your agreement. All fees are quoted in Euros and are subject to applicable Dutch VAT.

Client Responsibilities

As a client, you are responsible for providing accurate and complete information about your property, maintaining appropriate insurance coverage, complying with all applicable laws and regulations, providing Techoras with necessary access to the property, and paying fees according to the agreed schedule. You must promptly notify us of any changes that may affect our services.

Intellectual Property

All content on the Techoras website, including text, graphics, logos, images, software, and other materials, is the property of Techoras B.V. or its licensors and is protected by Dutch and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without written permission. The Techoras name and logo are trademarks of Techoras B.V.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

Limitation of Liability

To the maximum extent permitted by Dutch law, Techoras B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our website or services. Our total liability for any claim shall not exceed the fees paid by you for the specific service giving rise to the claim in the twelve months preceding the claim.

Force Majeure

Techoras shall not be liable for any failure to perform its obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labour disputes, or technical failures. In such cases, we will make reasonable efforts to minimise disruption and resume normal service as soon as possible.

Termination

Either party may terminate a service agreement in accordance with the termination provisions specified in the individual agreement. Techoras reserves the right to terminate or suspend access to our website immediately if you violate these Terms of Service. Upon termination, your right to use our services and website will cease, but provisions regarding liability, intellectual property, and dispute resolution shall survive.

Modifications to Terms

Techoras reserves the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the updated terms on our website and updating the "Last Updated" date. Continued use of our services after such modifications constitutes acceptance of the updated terms.

Dispute Resolution

We encourage resolving any disputes through direct communication first. If a dispute cannot be resolved amicably, both parties agree to attempt mediation before pursuing litigation. Any mediation or litigation shall be conducted in accordance with Dutch law and procedures.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any individual service agreements, constitute the entire agreement between you and Techoras B.V. regarding the use of our website and services. These terms supersede all prior or contemporaneous communications and proposals relating to the subject matter.
